These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and OMNISPHERE LLC (“Company,” “we,” “us,” or “our”), the operator of this Site. OMNISPHERE LLC is located at 1209 Mountain Road PL NE, STE N, Albuquerque, NM 87110.

By accessing, browsing, or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not access or use the Site.

We reserve the right to update or modify these Terms at any time. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.

Use of the Website

Age Requirement. You must be at least eighteen (18) years of age to use this Site. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Products and Services

The Site offers the Recovie™ 3-in-1 Leg Massager, a hospital-grade dynamic compression therapy device designed for personal wellness and comfort use. The current retail price is $109.95 USD, subject to change without notice.

We make every effort to display product descriptions, images, and pricing as accurately as possible. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free. In the event a product is listed at an incorrect price or with incorrect information, we reserve the right to refuse or cancel any orders placed for that product.

Product availability is subject to change at any time without notice. We reserve the right to limit the quantities of any products offered on the Site and to discontinue any product at any time.

Orders and Payment

Order Acceptance. Your placement of an order on the Site constitutes an offer to purchase the products selected. All orders are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

Payment Processing. All payments are processed securely through Shopify Payments and its supported payment providers. By submitting your payment information, you represent and warrant that you are authorized to use the designated payment method. You agree to pay all charges incurred under your account, including applicable taxes, shipping fees, and any other fees disclosed at the time of purchase.

We are not responsible for any additional fees charged by your bank or payment provider, including but not limited to currency conversion fees or international transaction fees.

Shipping and Delivery

Shipping timelines, costs, and available delivery methods are described on our Shipping Policy page. Estimated delivery dates are approximate and not guaranteed. We are not liable for delays caused by carriers, customs processing, weather events, or other circumstances beyond our reasonable control.

Risk of loss and title for items purchased from the Site pass to you upon delivery of the items to the carrier. Please refer to our Shipping Policy page for full details.

Returns and Refunds

We stand behind the quality of our products. The Recovie™ 3-in-1 Leg Massager comes with a 90-day money-back guarantee. If you are not satisfied with your purchase, you may return the product within ninety (90) days of delivery for a full refund, subject to the terms and conditions set forth in our Refund Policy page.

The Recovie™ name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of OMNISPHERE LLC. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content on this Site without the prior written consent of OMNISPHERE LLC, except as permitted by applicable law.

User Content

By submitting any content to the Site, including but not limited to product reviews, comments, photographs, videos, or other materials (“User Content”), you grant OMNISPHERE LLC a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from such User Content in any media or format, whether now known or hereafter developed.

You represent and warrant that you own or have the necessary rights to submit the User Content and that the User Content does not violate the rights of any third party, including intellectual property rights and privacy rights.

We reserve the right, but are not obligated, to review, edit, or remove any User Content at our sole discretion, including content that we determine to be unlawful, offensive, threatening, defamatory, or otherwise objectionable.

Prohibited Activities

In addition to the restrictions set forth above, you expressly agree not to engage in any of the following prohibited activities:

•       Engaging in any activity that could damage, disable, overburden, or impair the functioning of the Site.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OMNISPHERE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

•       Your access to or use of (or inability to access or use) the Site;

•       Any conduct or content of any third party on the Site;

•       Any content obtained from the Site; or

•       Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

Indemnification

You agree to defend, indemnify, and hold harmless OMNISPHERE LLC, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

•       Your violation of these Terms;

•       Your use of the Site, including but not limited to your User Content, any use of the Site’s content, services, or products other than as expressly authorized in these Terms;

•       Your violation of any third-party right, including any intellectual property, publicity, confidentiality, property, or privacy right; or

•       Any claim that your User Content caused damage to a third party.

Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Governing Law. These Terms and any dispute arising out of or related to these Terms or the Site shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.

Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in Albuquerque, New Mexico, before a single arbitrator. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Class Action Waiver. YOU AND OMNISPHERE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and OMNISPHERE LLC agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class, consolidated, or representative proceeding.

Individual Claims Only. All claims and disputes within the scope of this arbitration agreement must be arbitrated on an individual basis and not on a class or collective basis. Only individual relief is available, and claims of more than one customer or user cannot be arbitrated or consolidated with those of any other customer or user.

Opt-Out Right. You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by sending a written notice of your decision to opt out to: OMNISPHERE LLC, 1209 Mountain Road PL NE, STE N, Albuquerque, NM 87110, or by emailing support@recovie.com with the subject line “Arbitration Opt-Out.” Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of this arbitration agreement. If you opt out, all other provisions of these Terms will continue to apply.

Exceptions. Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of its jurisdiction. Either party may also seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

Modifications to Terms

We reserve the right to revise and update these Terms at our sole discretion, at any time and without prior notice. All changes are effective immediately when posted and apply to all access to and use of the Site thereafter.

We will indicate the date of the most recent revision at the bottom of this page. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page periodically so you are aware of any changes, as they are binding on you.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and these Terms shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein. The remaining provisions shall continue in full force and effect.
